Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before using any services offered by ARRA Couriers (“we,” “our,” or “us”). By accessing our website at arracouriers.com, placing a delivery order, or using any of our courier services, you (“Customer,” “you,” or “your”) agree to be legally bound by these Terms in their entirety.

These Terms constitute a binding legal agreement between you and ARRA Couriers and govern all transactions, interactions, and use of our platform and services. If you do not agree to these Terms, you must not use our services.

1. Definitions

For the purposes of these Terms, the following definitions apply:

  • “ARRA Couriers” refers to the courier and logistics company operating under that name in Jamaica, reachable at arracouriers.com and +1876-221-9211.
  • “Services” means all courier, delivery, pick-up, handling, and related logistics services provided by ARRA Couriers.
  • “Shipment” or “Package” means any parcel, document, item, or consignment accepted by ARRA Couriers for delivery.
  • “Customer” means any individual, business, or organisation that engages our Services.
  • “Recipient” means the person or entity designated to receive a Shipment.
  • “Website” refers to arracouriers.com and any associated mobile or digital platforms.
  • “Personal Data” has the meaning ascribed to it under the Data Protection Act of Jamaica (2020) and includes any information that identifies or can identify a natural person.
  • “Prohibited Items” refers to goods that ARRA Couriers will not transport as listed in Section 7 of these Terms.

2. Acceptance of Terms

By using our Services — whether in person, by telephone, through our Website, or via any authorised third-party platform — you acknowledge that:

  • You have read, understood, and agree to these Terms in full.
  • You are at least 18 years of age or have the legal capacity to enter into a binding contract under Jamaican law.
  • Where you are acting on behalf of a company or other legal entity, you have the authority to bind that entity to these Terms.
  • You agree to our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting to the Website. Continued use of our Services after any modification constitutes acceptance of the revised Terms.

3. Our Services

3.1 Scope of Services

ARRA Couriers provides domestic courier and delivery services within Jamaica, including but not limited to:

  • Same-day and next-day package delivery
  • Scheduled and recurring deliveries
  • Business-to-business logistics
  • Last-mile delivery solutions
  • Document courier services
  • E-commerce fulfilment and delivery

3.2 Service Availability

Our Services are subject to availability and operational capacity. ARRA Couriers reserves the right to refuse, limit, or withdraw any Service at its sole discretion. Service areas, operating hours, and delivery windows are published on the Website and may change without prior notice.

3.3 Third-Party Service Providers

We may engage subcontractors, independent contractors, or third-party logistics partners to fulfil deliveries. Such engagement does not alter our obligations to you under these Terms. We remain responsible for ensuring that any third party engaged by us adheres to standards consistent with these Terms.

4. Booking, Orders & Confirmation

4.1 Placing a Booking

Orders may be placed via the Website, telephone (+1876-221-9211), or any other channel authorised by ARRA Couriers. All bookings are subject to acceptance by us. A booking confirmation (electronic or verbal) constitutes a service agreement for that specific Shipment.

4.2 Accurate Information

You are responsible for providing complete, accurate, and current information including sender and recipient names, addresses, contact numbers, and a proper description of the Shipment contents. ARRA Couriers shall not be liable for delivery failures, delays, or losses arising from incorrect or incomplete information provided by the Customer.

4.3 Modifications & Cancellations

Cancellations or changes to a booking must be communicated to us before the Shipment has been collected. Once a Shipment is in transit, modifications may not be possible. Cancellations made after collection may be subject to a handling fee.

5. Fees, Payment & Invoicing

5.1 Pricing

Service fees are calculated based on factors including package dimensions, weight, delivery distance, service tier, and any applicable surcharges. All applicable fees are communicated to the Customer before confirmation of the booking. Prices are quoted in Jamaican Dollars (JMD) unless otherwise agreed in writing.

5.2 Payment Terms

Payment is due at the time of booking or upon delivery, in accordance with the agreed payment method. ARRA Couriers accepts cash, bank transfer, mobile payments, and other payment methods as indicated on the Website. Invoices for corporate accounts are due within the payment period specified on the invoice.

5.3 Late Payments

Overdue balances on corporate or credit accounts may attract a late payment fee. ARRA Couriers reserves the right to suspend Services for accounts with outstanding balances until full payment is received.

5.4 Taxes & Duties

All applicable government taxes, General Consumption Tax (GCT), duties, and levies are the sole responsibility of the Customer or Recipient unless otherwise agreed in writing. ARRA Couriers may advance such payments on your behalf and subsequently recover them from you.

6. Packaging & Condition of Goods

The Customer is responsible for ensuring that all Shipments are:

  • Properly and securely packaged to withstand ordinary handling conditions during transport.
  • Clearly labelled with the correct sender and recipient details.
  • Free from any external markings that could be misleading or offensive.

ARRA Couriers reserves the right to reject any Shipment that, in our reasonable judgment, is inadequately packaged or labelled. We are not responsible for damage to items that results from poor packaging by the Customer. We may repackage a Shipment at our discretion, and any cost incurred shall be borne by the Customer.

7. Prohibited & Restricted Items

7.1 Absolutely Prohibited Items

ARRA Couriers will not knowingly accept or transport the following under any circumstances:

  • Illegal drugs, controlled substances, or narcotics
  • Firearms, ammunition, explosives, or weapons of any kind
  • Human remains or body parts
  • Live animals (unless expressly agreed under a separate written agreement)
  • Counterfeit currency, fraudulent documents, or items of a fraudulent nature
  • Pornographic or obscene materials
  • Stolen goods or items obtained through criminal means
  • Hazardous materials, including toxic chemicals, flammable gases, biohazards, and radioactive substances, unless covered by a specific certified agreement

7.2 Declaration Requirement

Customers must fully and accurately declare the contents of all Shipments. Providing a false or misleading declaration is a serious breach of these Terms and may expose the Customer to civil and criminal liability under Jamaican law, including under the Customs Act, the Dangerous Drugs Act, and the Firearms Act.

7.3 Inspection Rights

ARRA Couriers reserves the right to inspect any Shipment where there is reasonable cause to suspect it contains Prohibited Items. We will cooperate fully with Jamaican law enforcement and regulatory authorities in any investigation related to the contents of a Shipment.

8. Delivery, Collection & Receipt

8.1 Delivery Attempts

ARRA Couriers will make reasonable attempts to deliver a Shipment to the address specified in the booking. If the Recipient is unavailable and safe delivery cannot be completed, we will:

  • Leave a delivery notification card or send an electronic notification, and
  • Attempt a second delivery on the next business day, or hold the Shipment for Customer-directed re-delivery, or
  • Return the Shipment to the sender after a reasonable holding period.

Repeated failed delivery attempts may result in storage fees. ARRA Couriers is not liable for losses caused by the Recipient’s unavailability.

8.2 Proof of Delivery

Upon delivery, the Recipient or an authorised representative may be required to sign for the Shipment. A digital or physical signature constitutes proof of delivery and receipt in satisfactory condition unless objection is noted at the time of delivery.

8.3 Delivery Timeframes

All delivery timeframes quoted are estimates only. While we endeavour to meet stated delivery windows, ARRA Couriers does not guarantee specific delivery times. We shall not be liable for delays caused by traffic, adverse weather, civil unrest, acts of God, government action, or other circumstances beyond our reasonable control (Force Majeure events).

9. Liability, Loss & Damage

9.1 Our Liability

ARRA Couriers takes care in handling all Shipments. Subject to the exclusions and limitations set out in this Section, we accept liability for direct loss or damage to a Shipment caused by our proven negligence while the Shipment is in our custody.

9.2 Limitation of Liability

Our total liability for any single claim arising out of or in connection with a Shipment shall not exceed:

  • The declared value of the Shipment, or
  • JMD $50,000 (Fifty Thousand Jamaican Dollars), whichever is lower,

unless the Customer has purchased additional declared value coverage or insurance at the time of booking and paid the applicable premium.

9.3 Exclusions

ARRA Couriers shall not be liable for:

  • Loss or damage caused by inadequate packaging by the Customer.
  • Delay, loss, or damage resulting from Force Majeure events.
  • Loss of income, profit, revenue, or any indirect, consequential, or special damage howsoever arising.
  • Perishable items that are delayed due to circumstances beyond our control.
  • Loss or damage to Prohibited Items or undeclared goods.
  • Damage that is pre-existing at the time of collection.

9.4 Claims Process

All claims for loss or damage must be submitted in writing to info@arracouriers.com or by calling +1876-221-9211 within seven (7) calendar days of the scheduled delivery date. Claims submitted outside this window may not be entertained. Supporting documentation including proof of value, photographs, and the original booking reference must accompany all claims.

10. Customer Obligations

As a Customer of ARRA Couriers, you agree to:

  • Provide truthful, accurate, and complete information at all times.
  • Comply with all applicable Jamaican laws and regulations in relation to the goods you send.
  • Not use our Services to transport Prohibited Items.
  • Ensure that the Recipient is aware of the pending delivery and is available or has made appropriate arrangements to receive it.
  • Not engage in any conduct that is abusive, threatening, or harassing toward our staff or contractors.
  • Promptly pay all fees and charges applicable to your use of our Services.

11. Data Protection & Privacy (Jamaica Data Protection Act 2020)

11.1 Our Commitment

ARRA Couriers is committed to full compliance with the Data Protection Act (Jamaica) 2020 (“DPA”) and any regulations made thereunder. We process Personal Data fairly, lawfully, and transparently, collecting only what is necessary for the delivery of our Services.

11.2 Personal Data We Collect

In the course of providing our Services, we may collect and process the following categories of Personal Data:

  • Full name, address, and contact information of Customers and Recipients
  • Payment information (processed securely through compliant payment processors)
  • Shipment details, including descriptions of package contents
  • Communications and correspondence with our team
  • Website usage data, cookies, and device identifiers
  • Delivery confirmation data including digital signatures

11.3 Legal Basis for Processing

We process Personal Data on the following legal grounds as defined under the DPA:

  • Performance of a contract — to fulfil the delivery services you have engaged us for.
  • Legal obligation — to comply with regulatory, tax, and law enforcement requirements.
  • Legitimate interests — for fraud prevention, business operations, and service improvement.
  • Consent — for marketing communications (which you may withdraw at any time).

11.4 Data Sharing

We may share Personal Data with:

  • Our delivery partners and subcontractors engaged to fulfil your Shipment.
  • Payment processing providers.
  • Government authorities and law enforcement where required by law.
  • IT service providers and cloud hosting partners, subject to appropriate data processing agreements.

We do not sell Personal Data to third parties. Where data is shared with third parties, we ensure appropriate contractual safeguards are in place.

11.5 Data Retention

Personal Data is retained only for as long as necessary to fulfil the purpose for which it was collected, or as required by applicable Jamaican laws and regulations. Transaction records are generally retained for a minimum of seven (7) years in compliance with tax and accounting requirements.

11.6 Your Rights Under the DPA

As a data subject under the Jamaican DPA, you have the following rights:

  • Right of Access — to obtain a copy of the Personal Data we hold about you.
  • Right to Rectification — to correct inaccurate or incomplete data.
  • Right to Erasure — to request deletion of your data in certain circumstances.
  • Right to Restrict Processing — to limit how we use your data in certain circumstances.
  • Right to Object — to object to processing based on legitimate interests or for direct marketing.
  • Right to Data Portability — to receive your data in a structured, machine-readable format.

11.7 Cookies & Website Tracking

Our Website uses cookies and similar tracking technologies to enhance your browsing experience and to gather analytical data. You may manage cookie preferences through your browser settings. 11.8 Security

We implement appropriate technical and organisational security measures to protect Personal Data against unauthorised access, disclosure, alteration, or destruction. These include encrypted data transmission, access controls, and regular security assessments. In the event of a data breach that poses a risk to your rights and freedoms, we will notify you and the relevant supervisory authority in accordance with the DPA.

12. Intellectual Property

All content on the Website, including but not limited to logos, trademarks, graphics, text, software, and service marks, is the exclusive property of ARRA Couriers or its licensors and is protected under Jamaican and international intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for the purpose of engaging our Services. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

13. Website Use & Acceptable Use Policy

You agree that when using our Website you will not:

  • Introduce viruses, malware, or any other harmful or disruptive code.
  • Attempt unauthorised access to any part of our systems, servers, or databases.
  • Use automated bots or scrapers to extract data from the Website.
  • Engage in any conduct that disrupts, damages, or impairs the functioning of the Website.
  • Post or transmit any content that is fraudulent, defamatory, obscene, or unlawful.
  • Impersonate ARRA Couriers or any of its employees, agents, or representatives.

Any breach of this Section may result in immediate suspension of your account and access to our Services, and may be reported to the relevant Jamaican authorities.

14. Indemnification

You agree to indemnify, defend, and hold harmless ARRA Couriers, its officers, directors, employees, agents, and subcontractors from and against any claims, liabilities, damages, penalties, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms.
  • Any false or misleading declarations made in connection with a Shipment.
  • Your use of our Services in violation of any applicable law or regulation.
  • Any third-party claim arising from goods you sent through our Services.

15. Force Majeure

ARRA Couriers shall not be in breach of these Terms or liable for any delay or failure to perform our obligations if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, hurricanes, floods, earthquakes, civil unrest, industrial disputes, government action, road closures, power outages, telecommunications failures, or pandemics.

In the event of a Force Majeure occurrence, we will notify affected Customers as soon as reasonably practicable and endeavour to resume Services at the earliest opportunity.

16. Dispute Resolution

16.1 Internal Resolution

In the event of a dispute, we encourage Customers to first contact us directly at info@arracouriers.com or +1876-221-9211 so that we may attempt to resolve the matter amicably within fifteen (15) business days.

16.2 Mediation

If a dispute cannot be resolved internally, both parties agree to attempt resolution through a recognised mediation service in Jamaica before commencing formal legal proceedings.

16.3 Governing Law & Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Jamaica. The parties submit to the exclusive jurisdiction of the courts of Jamaica.

17. Termination & Suspension

ARRA Couriers reserves the right to terminate or suspend your access to our Services at any time and without prior notice if:

  • You are in breach of these Terms.
  • You have provided false, misleading, or fraudulent information.
  • You have engaged in abusive conduct toward our staff or contractors.
  • We are required to do so by law or a government authority.

Termination of Services shall not affect any outstanding obligations, payments, or liabilities that accrued prior to the date of termination.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other policies incorporated by reference, constitute the entire agreement between you and ARRA Couriers with respect to your use of our Services and supersede all prior agreements, representations, or understandings.

18.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

18.3 Waiver

No failure or delay by ARRA Couriers in exercising any right, power, or remedy under these Terms shall constitute a waiver of that right, power, or remedy.

18.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. ARRA Couriers may assign its rights under these Terms to any successor entity or in connection with a merger, acquisition, or sale of assets.

18.5 Notices

All formal notices under these Terms must be in writing and delivered to ARRA Couriers via email to info@arracouriers.com or by post to our registered place of business in Jamaica.
